Federal Court Mandates Release of Abrego Garcia from ICE Custody

Legal scene

A federal judge has ordered the immediate discharge of Kilmar Abrego Garcia from detention by ICE, finding his continued confinement is without lawful basis.

"Since Abrego Garcia's release after wrongful detention in El Salvador, he has been taken back into custody, again without lawful authority," the judge stated in her order.

The situation stems from a erroneous deportation to El Salvador in March, which US authorities later acknowledged was an mistake. Following his return to the United States to answer human smuggling allegations, he was detained in immigration custody.

In her order, the judge noted that the authorities lacks a valid deportation order, which prevents them from deporting Mr. Abrego Garcia "at this juncture."

Background of the Case

The legal proceedings involve conflicting claims. Whereas the former administration contends that Abrego Garcia is a member of the MS-13 gang, he vehemently denies this claim.

He has also pleaded not guilty to the smuggling counts, which are part of a ongoing trial in Tennessee.

Terms of Release

The court, who was overseeing his challenge to removal in a federal court, determined that he must now adhere to the terms of his bond from custody in Tennessee. This decision shifts his supervision to the Tennessee court.

This decision represents a notable turn in a complex legal case featuring claims of mistaken imprisonment and disputed gang affiliations.
